Terms of Service

Please read these Terms of Service carefully before using the Buddy 4 Golf application. These terms govern your use of our services and outline the rights and responsibilities of all users.
1. Acceptance of Terms
By accessing and using Buddy 4 Golf (“the App”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on Buddy 4 Golf for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on Buddy 4 Golf; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server.
3. User Account
To access certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service.
4. Buddy Credits and Tier System
Buddy Credits are virtual currency earned through app usage and can be redeemed for benefits within the App. Credits have no cash value and cannot be transferred or sold. The tier system (Bronze, Silver, Gold, Platinum) is based on accumulated credits and activity. Buddy 4 Golf reserves the right to modify the credit earning rates, redemption values, and tier requirements at any time with reasonable notice.
5. Golf Club Partnerships
Golf clubs partnering with Buddy 4 Golf agree to provide accurate information about their facilities, pricing, and availability. Clubs are responsible for managing their tee time inventory and honoring bookings made through the App. Partnership terms may vary and will be detailed in separate partnership agreements.
6. User Conduct
You agree not to use the App to: upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable; impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; upload, post, or transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships; interfere with or disrupt the App or servers or networks connected to the App.
7. Content
Our App allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content that you post on or through the App, including its legality, reliability, and appropriateness. By posting Content on or through the App, you represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the App does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity.
8. Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the App or contact us to request account deletion.
9. Limitation of Liability
In no event shall Buddy 4 Golf, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
10. Privacy Policy
Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the App and informs users of our data collection practices. By using the App, you consent to the collection and use of your information as outlined in our Privacy Policy.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
